Terms of Service

1. Overview

Brody is an indie project — an AI-powered SMS accountability buddy built and operated by an individual developer. By using the Service, you agree to these Terms. If you don't agree, please don't use it. These Terms may be updated at any time; continued use means you accept the latest version.

2. Eligibility

You must be at least 13 years old to use Brody. By using the Service, you confirm you meet this requirement. If you're between 13 and 18, please make sure a parent or guardian is aware you're using it.

3. SMS Messaging & Consent

By providing your phone number, you consent to receive automated text messages from Brody at that number. This is the core of how the Service works. Standard carrier message and data rates may apply. Message frequency varies based on your activity and settings.

You can opt out at any time by replying STOP to any message. You'll get one confirmation and no further messages after that. Please note it may take up to 14 days for your opt-out to fully take effect in our systems — you may receive a few scheduled messages during that window. Reply HELP or email textbrody@gmail.com for help.

We're not responsible for delays or failures caused by your carrier or network.

4. Acceptable Use

Please don't use Brody to:

• Break any laws or regulations
• Harass, threaten, or harm anyone
• Spam or send harmful content
• Attempt to hack, overload, or disrupt the Service
• Impersonate someone else

We reserve the right to suspend or terminate access for violations, at our discretion.

5. Payments & Refunds

Paid features are processed through Stripe. By entering payment details, you authorize us to charge your payment method for the selected plan.

Subscriptions renew automatically unless cancelled before the renewal date. You can cancel anytime from your account settings and retain access through the end of the billing period.

Refunds. All sales are generally final. We don't offer refunds for partial periods or unused time. If you think you were charged by mistake, email us at textbrody@gmail.com within 7 days and we'll sort it out.

Free trials, if offered, convert automatically to paid at the end of the trial unless cancelled beforehand.

6. No Warranties

Brody is provided "as is." As an indie project, we can't guarantee the Service will be available 100% of the time, error-free, or that AI-generated messages will always be accurate or appropriate.

Brody is a motivational tool — it is not a substitute for professional fitness, medical, or nutritional advice. Use your own judgment.

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of Brody. Our total liability for any claim is limited to the amount you paid us in the 3 months prior to the claim, or $50 — whichever is greater.

8. Your Content

You own the messages you send. By using the Service, you grant us a license to store and process your messages to deliver and improve Brody. We may use anonymized conversation data to improve AI responses.

9. Termination

You can stop using Brody at any time. We can suspend or close accounts that violate these Terms. If your account is terminated for a violation, you won't be entitled to a refund for any remaining subscription period.

10. Disputes

If you have a problem with the Service, please just reach out first at textbrody@gmail.com — as an indie project, we genuinely want to make it right. These Terms are governed by applicable law in the jurisdiction where the Service is operated.
